Tenant Insurance Commission Claims – You could be owed £100s or £1,000s

Were you asked to take out insurance as part of your tenancy? You may be entitled to claim back commission payments made to landlords or letting agents without your knowledge.

Following a major legal breakthrough – confirmed by the UK Supreme Court in 2025 – tenants can now legally recover hidden commissions paid in relation to tenant or landlord insurance policies.

🔎 What’s Changed? The Legal Background

In the case of Wilkins v GFM Ltd [2024], the Court of Appeal held that tenants were entitled to recover undisclosed commission payments taken by letting agents or landlords when arranging insurance policies.

That decision was upheld by the Supreme Court in 2025, confirming that:

    • Where a landlord or agent arranges insurance and receives a commission from the insurer

    • And fails to disclose that commission to the tenant

    • The tenant may be entitled to a refund of the commission and/or compensation

This includes many policies such as:

    • Tenant liability insurance

    • Contents insurance for tenants

    • Landlord insurance charged through rent

The ruling has paved the way for thousands of Tenant Insurance Commission Claims and ERC Refunds (Excessive Rent Charges) across the UK.

✅ You May Have a Claim If:

    • You rented in the last 6 years

    • You were asked or required to take out insurance

    • You were not clearly told a commission would be paid

    • You suspect the policy cost was inflated or bundled into rent

💷 What Could You Recover?

    • Commission payments taken without your knowledge

    • Potential overcharging via rent or fees

    • In some cases, compensation for unfair treatment or breach of trust
